Professional Indemnity

Professional Indemnity is a section of the General Liability Policy.

Who is covered under this section of the Policy?

Means a qualified person appointed by the club, league or association to act as a coach/official but only whilst acting in the scope of their duties in such capacity. Qualified shall mean that person has appropriate qualifications or registration or accreditation or authorisation from the Insured body.

What does the Professional Indemnity section cover?

This section of the policy will indemnify the insured against any claim or claims (including all legal costs and expenses for which the insured shall become legally liable to the claimant) up to but not exceeding in the aggregate for all claims under this policy, the limit of indemnity specified in the schedule arising from breach of professional duty whether such duty is owed in contract or otherwise in respect of the insured’s legal liability arising from negligent acts, errors or omissions whenever or wherever committed or alleged to have been committed in connection with The Sport, provided that the Claim or Claims are:

  1. made against the Insured during the period of insurance specified in the schedule and,
  2. immediately notified in writing to the Company by the Insured during the period of insurance,
  3. arising out of any act, error or omission which occurred subsequent to the Retroactive Date.

How much does the Professional Indemnity section cover?

$20,000,000 each and every and in the aggregate during the period of insurance.

Excess – first $1,000 payable by the club and balance up to $10,000 payable by Netball Australia.

Legal costs and expenses in addition to the Limit of Liability Important Information regarding the Professional Indemnity section

The Professional Indemnity section of this policy is written on a Claims Made Basis. This means that this part of the Liability cover provides cover (subject to its terms and conditions) for claims which are first made against you and immediately notified to the insurer in writing during the period of insurance, subject to the retroactive period.

We strongly recommend that you implement a program to ensure that all claims are identified and notified immediately and within the period of insurance as no claims can be made After expiry of the period of insurance.

Where you become aware of facts or circumstances that might give rise to a claim, you should forward to us a notice in writing outlining those facts or circumstances immediately and before expiry of the period of insurance. We will forward the notice to the Insurers on your behalf. Delay in notifying the insurer or failure to provide all relevant facts could result in the claim being denied.
